Terms of Service

1. Agreement to Terms
By accessing and using ClipSpark.de ("Service"), operated by Eduard Röhrig, Iris-Runge-Platz 11, 30539 Hannover, Germany ("we", "us"), you agree to be bound by these Terms of Service. If you disagree with any part, you may not use the Service.
2. Description of Service
ClipSpark is a digital video processing service that allows users to:
- Upload gaming clips and video recordings
- Automatically convert videos to vertical format (9:16) with AI-generated captions
- Apply custom overlays and branding
- Download or upload processed clips to social media platforms
3. Eligibility
You must be at least 16 years old to use ClipSpark. By creating an account, you confirm that you meet this age requirement.
4. User Accounts
You must create an account to use our Service. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify us immediately at contact@clipspark.de of any unauthorized access.

All prices are in Euros and include applicable taxes. Subscriptions are billed monthly and renew automatically unless cancelled.
5.1 Payment
Payments are processed securely by Stripe, Inc. We accept credit cards, debit cards, and other methods supported by Stripe. We never store your payment card details.
5.2 Cancellation
You may cancel your subscription at any time through your Account Settings or the Stripe billing portal. Cancellation takes effect at the end of the current billing period. You retain access to paid features until the end of the period.
6. Right of Withdrawal (Widerrufsrecht)
Withdrawal Notice for EU/EEA Consumers
You have the right to withdraw from your subscription within 14 days without giving any reason. The withdrawal period starts on the day the contract is concluded.
To withdraw, send a clear statement (e.g., email) to: contact@clipspark.de
Early loss of withdrawal right: If you consent to the immediate start of the digital service before the withdrawal period expires, and acknowledge that your withdrawal right is lost upon full performance of the service within the billing period, the withdrawal right expires accordingly (BGB § 356 Abs. 4).
7. Acceptable Use
You may not:
- Upload content that infringes copyright, trademark, or other intellectual property rights
- Upload content containing violence, hate speech, CSAM, or illegal material
- Attempt to reverse engineer, exploit, or abuse the Service
- Use automated tools to scrape or overload the Service
- Share your account credentials or API keys with unauthorized parties
- Use the Service for any unlawful purpose
8. Content & Intellectual Property
8.1 Your Content
You retain full ownership of all content you upload. By uploading, you grant us a limited, temporary license solely to process and deliver the content back to you.
8.2 Our Service
ClipSpark, including its software, design, and technology, is our intellectual property. You may not copy, modify, or redistribute any part of the Service.
8.3 Content Storage
Uploaded and processed videos are stored for up to 30 days and then automatically deleted. Demo videos are deleted after 1 hour.
9. Privacy
Your privacy is important to us. Please review our Privacy Policy for details on how we handle your data.
10. Service Availability
We strive for reliable service but cannot guarantee 100% uptime. We may perform maintenance that temporarily interrupts availability. We are not liable for downtime or processing delays.
11. Limitation of Liability
To the maximum extent permitted by law, ClipSpark shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Termination
We may suspend or terminate your account if you breach these Terms. You may delete your account at any time through Account Settings, which permanently removes all your data (GDPR Art. 17). Upon termination, your right to use the Service ceases immediately.
13. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance. If you disagree, you may cancel your subscription and delete your account.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Federal Republic of Germany. For consumers residing in the EU/EEA, mandatory consumer protection laws of your country of residence also apply.

We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
